Terms of Service

1. Who can use FlawdaScene

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or pay for a subscription. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. The Service

FlawdaScene is a discovery platform where Florida-based businesses ("Vendors") publish events and the general public ("Attendees") browse, save, and share them. FlawdaScene does not produce, host, or operate the events themselves. Events are independently organized, marketed, and run by third-party Vendors. We do not verify Vendor claims, capacity, safety, age requirements, or compliance with applicable laws.

Information on event detail pages — including dates, prices, venues, photos, and videos — is supplied by Vendors and may change or be inaccurate. Always confirm event details directly with the Vendor before traveling or purchasing tickets.

3. Attendee conduct

When you attend an event listed on FlawdaScene, you do so at your own risk. You agree to follow all applicable laws and the Vendor's rules. Disputes about admission, refunds, quality, conduct, or injuries are between you and the Vendor — not FlawdaScene.

4. Vendor accounts and content

Vendors are responsible for the accuracy, legality, and rights to all content they upload, including text, images, and videos. By posting content, Vendors grant FlawdaScene a worldwide, royalty-free, non-exclusive license to display, distribute, and promote that content within the Service and across our marketing channels (including the FlawdaScene YouTube channel and email newsletter). Vendors retain ownership of their content.

Vendors agree not to post content that is illegal, infringing, defamatory, harassing, fraudulent, or sexually explicit. We may remove content and suspend accounts that violate these rules at our sole discretion.

5. User-submitted content (attendee videos)

Attendees may submit videos of events through the "From the crowd" feature. By submitting, you confirm you own the rights to the video or have permission from anyone identifiably shown in it, and you grant FlawdaScene the same license described in Section 4. Submissions go through admin review before publication. We may decline or remove any submission for any reason.

6. Subscriptions, billing, and refunds

Vendor plans (Basic, Spotlight, Pro) are billed monthly in advance through Stripe after a 30-day free trial. You authorize us to charge your payment method on each renewal until you cancel. Cancellation is available anytime from your dashboard or through the Stripe billing portal — cancelling stops future renewals but does not refund the current period. Add-ons (boosted posts, featured placement, ticket commissions) are non-refundable once activated.

7. Email outreach and communications

We may send transactional emails about your account, trial, billing, and event activity. Vendors and subscribers can opt out of marketing emails at any time using the unsubscribe link in the footer or by replying with "unsubscribe". We comply with the U.S. CAN-SPAM Act.

8. Acceptable use

You agree not to:

• Scrape, crawl, or harvest data from the Service without our written consent.
• Reverse-engineer or attempt to bypass rate limits, authentication, or paywalls.
• Use the Service to send spam, phishing attempts, or malware.
• Impersonate another business or person.
• Post events you do not have authority to organize or promote.

9. Disclaimers — read this carefully

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that listings will be accurate or up to date.

FlawdaScene is not responsible for events. We do not promise that events will occur as described, that venues will be safe, or that Vendors will deliver what they advertise. Your decision to attend, pay for, or interact with any event is your own.

10. Limitation of liability

To the maximum extent permitted by law, FlawdaScene and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, personal injury, or property damage — arising from your use of the Service or attendance at any event listed on it. Our total cumulative liability for any claim related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US$100.

11. Indemnification

You agree to defend, indemnify, and hold harmless FlawdaScene from any claims, damages, and expenses arising from your use of the Service, your content, your events, or your breach of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida without regard to conflict-of- law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Orange County, Florida, and you consent to personal jurisdiction there.

13. Changes

We may update these Terms occasionally. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
